1. Acceptance of Terms
By accessing or using Emol you agree to these Terms. If you do not agree, please do not use the platform.
2. Your Account
You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account. You must be of legal age in your jurisdiction to transact.
3. Listings & Conduct
You may list only items, services and properties you are legally entitled to offer. Prohibited, counterfeit, stolen, or illegal items are not allowed. You are solely responsible for your listings, communications and transactions. Emol may remove content or suspend accounts that violate these Terms.
4. Transactions
Emol is a marketplace that connects buyers and sellers; we are not a party to transactions between users. Always use in-app/official channels, verify items before paying, and avoid sharing sensitive information. Use payment protection where available.
5. Content License & Marketing
By posting any content — including listing photos, titles, descriptions, your business name, logo, store details and reviews (“Your Content”) — you grant Emol a worldwide, non-exclusive, royalty-free, fully paid, sublicensable and transferable license to host, store, use, reproduce, adapt, modify, resize, translate, publish, publicly display, perform and distribute Your Content for the purposes of operating, improving, promoting and marketing Emol and your listings. This license lasts for as long as Your Content is on the platform and for a reasonable period afterward for residual and archived marketing materials. You represent that you own or have all rights necessary to grant this license.
6. Promotional Use of Your Listings
You agree that Emol may feature, showcase, rank and promote your listings, products, services, businesses and store — at no cost to you and without further notice or compensation — across the platform and our marketing channels, including the homepage, category and search placements, advertisement banners, push and email notifications, social media, partner websites and other advertising. We may use Your Content to create promotional materials (such as “featured”, “trending” or curated collections) and to advertise Emol generally. You may request removal of specific content by contacting us, and we will use reasonable efforts to honor such requests on a going-forward basis.
7. Communications & Notifications
By creating an account you agree to receive service, transactional, security and account messages, which are required to use Emol. You may also receive marketing communications, promotions and notifications about features, deals and how your listings are performing. You can manage marketing and optional notifications in your preferences; required service and security messages cannot be disabled.
8. Fees
Posting listings is free. Optional promotion (ads) and certain services may carry fees, disclosed before you commit.
9. Marketplace Disclaimer
EMOL operates as a technology platform connecting buyers and sellers. EMOL is not the manufacturer, owner, distributor, reseller, or guarantor of products listed by independent sellers unless explicitly stated otherwise. Sellers are solely responsible for the accuracy, legality, quality, safety, condition, pricing, delivery, and fulfillment of products and services offered through the platform. EMOL does not guarantee the quality, safety, legality, authenticity, or availability of any product or service listed by third parties.
10. No Warranty — “As Is”
EMOL is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. EMOL does not guarantee uninterrupted, secure, or error-free operation of the platform, or that defects will be corrected.
11. No Guarantee of Sales
EMOL does not guarantee any level of traffic, views, impressions, leads, inquiries, or sales for sellers, nor any particular ranking or placement of listings, whether organic or promoted.
12. Limitation of Liability
To the fullest extent permitted by applicable law, EMOL, its owners, officers, employees, affiliates, partners, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, business opportunities, goodwill, data, or other intangible losses arising from the use of or inability to use the platform. EMOL's total liability for any claim arising out of or relating to the platform shall not exceed the amount paid by the user to EMOL, if any, during the twelve (12) months preceding the event giving rise to the claim.
13. Indemnification
Users agree to defend, indemnify, and hold harmless EMOL, its affiliates, officers, directors, employees, and agents from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable legal fees, arising out of:
- Violation of these Terms.
- Misuse of the platform.
- Violation of applicable laws or regulations.
- Infringement of intellectual property rights.
- Products, services, content, or activities provided by the user.
- Disputes between buyers and sellers.
14. Seller Responsibility
Sellers are fully responsible for their products and services, including descriptions, photos, specifications, pricing, stock availability, delivery, after-sales support, and compliance with all applicable laws, licenses, consumer-protection rules, and tax obligations.
15. User Content
Users are responsible for all content they post — photos, listings, reviews, ratings, profiles, and messages. You must own or have all necessary rights to any content you upload, and your content must not be unlawful, misleading, defamatory, or infringe the rights of others. EMOL may remove content that violates these Terms.
16. Refunds, Disputes & Chargebacks
Payments for goods and services are made directly between buyers and sellers (including cash on delivery); refunds are therefore provided by, and are the responsibility of, the seller. Buyers should inspect items on delivery before paying. Disputes between users may be reported through the in-app Report tools; EMOL may review evidence from both parties and, at its discretion, take platform-level actions such as removing listings or suspending accounts, but EMOL does not act as escrow and is not responsible for issuing refunds for transactions it did not process. For any fees paid to EMOL directly (such as advertising), chargebacks filed without first contacting support@emolapp.com may result in account suspension pending review.
17. Dispute Resolution & Arbitration
Where legally permitted, any dispute, claim, or controversy arising out of or relating to these Terms or the platform shall be resolved by binding individual arbitration, rather than in court, except that either party may bring qualifying claims in small-claims court. You and EMOL each waive the right to a trial by jury and to participate in a class action, to the extent permitted by applicable law. Before initiating arbitration, the parties agree to first attempt to resolve the dispute informally by contacting support@emolapp.com.
18. Force Majeure
EMOL shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including natural disasters, wars, terrorism, civil unrest, labor disputes, cyberattacks, internet or telecommunications failures, power outages, pandemics, or actions of governments or other authorities.
19. Suspension & Termination
EMOL may suspend, restrict, or terminate accounts and remove listings or content, with or without notice, for violations of these Terms or policies, suspected fraud, illegal activity, abuse of other users, or risk to the platform. Users may stop using the platform at any time; certain provisions (including licenses already granted, limitation of liability, and indemnification) survive termination.
20. Intellectual Property
The EMOL name, logo, design, and software are the property of EMOL and are protected by intellectual-property laws; you may not copy, modify, or reverse engineer them. You retain ownership of your content, subject to the license in Section 5. You must own or have rights to all content you upload, and you may not post content that infringes the trademarks, copyrights, or other rights of third parties. Repeat infringers' accounts may be terminated.
21. Governing Law
These Terms and any dispute arising out of or relating to them or the platform shall be governed by and construed in accordance with the laws of the United States of America, without regard to conflict-of-law principles, and, where state law applies, the laws of the State of Delaware. Any proceedings not subject to arbitration shall be brought exclusively in the courts located in the United States.
22. Account Deletion Policy
User-Initiated Account Deletion
Users may request deletion of their EMOL account at any time through the account settings page or by contacting support at support@emolapp.com.
Data Removal
Upon account deletion, personal profile information, login credentials, and user-generated content associated with the account may be permanently removed from EMOL's active systems, subject to legal, security, and operational requirements.
Retention of Certain Information
EMOL may retain certain information after account deletion where required by law, regulation, fraud prevention measures, dispute resolution, enforcement of agreements, financial recordkeeping, tax obligations, or security investigations.
Seller Accounts
If the account belongs to a seller, EMOL may retain transaction records, order history, payout information, tax records, and related business data as required for legal compliance, accounting, auditing, fraud prevention, and customer support purposes.
Pending Transactions
Accounts with unresolved disputes, active orders, chargebacks, refund requests, policy violations, or ongoing investigations may not be eligible for immediate deletion until such matters are resolved.
Deletion Processing Time
Account deletion requests may take up to 30 days to be fully processed. During this period, certain information may remain in backup or archival systems before being permanently removed according to EMOL's data retention procedures.
Irreversible Action
Once an account deletion request has been completed, the action may be irreversible. Users may lose access to their account, purchase history, saved preferences, messages, listings, and any other content associated with the deleted account.
Re-Registration
Users may create a new account after deletion, subject to EMOL's Terms of Service and eligibility requirements. Previously deleted account data may not be recoverable or transferable to a new account.
Right to Refuse Deletion
EMOL reserves the right to delay, restrict, or refuse account deletion requests where required to comply with legal obligations, prevent fraud, protect platform security, enforce policies, or preserve evidence related to disputes or investigations.
